TERMS & CONDITIONS

These Terms & Conditions are intended to clearly explain the scope of work, expectations, and responsibilities for both the Contractor and the Customer. Our goal is a smooth project, a great finished floor, and no surprises.
1. Scope of Work
The Contractor will install the flooring system described in the signed proposal using industry-standard materials and methods. Any work not expressly listed in the proposal is excluded from the scope unless agreed to in writing.
2. Concrete Conditions & Expectations
Concrete is a natural material and may contain cracks, pits, spalling, low spots, or other imperfections.
Coatings follow the existing concrete profile. We do not level, pitch, or regrade floors.
Low spots, uneven areas, and water pooling may remain visible after installation.
Cracks may reappear over time due to concrete movement, temperature changes, or substrate conditions.
Mineral deposits (lime, calcium, rust, or efflorescence) may resurface through or on top of coatings and are not preventable.
These conditions are considered normal and do not constitute defects.
3. Surface Preparation & Dust
Mechanical grinding and surface preparation are required for proper adhesion and will create dust and debris.
While the Contractor will take reasonable steps to limit dust migration, dust cannot be fully eliminated.
The Customer is responsible for:
Removing or protecting personal belongings
Covering doorways, vents, walls, and nearby items
Turning off HVAC systems prior to arrival
The Contractor is not responsible for dust-related cleaning outside the immediate work area.
4. Property & Pre-Existing Conditions
The Contractor is not responsible for damage resulting from pre-existing conditions, hidden defects, or normal risks inherent to surface preparation and coating installation.
The Customer acknowledges that items such as garage doors, weatherstripping, door tracks, sensors, trim, baseboards, walls, landscaping, and adjacent surfaces may experience incidental cosmetic impact.
Garage doors must be properly adjusted and provide adequate clearance prior to installation. The Contractor is not responsible for door interference caused by insufficient clearance or misalignment.
Any claims for damage must be reported promptly.
5. Vertical Surfaces & Edges
Vertical surfaces (stem walls, curbs, transitions, edges) are coated in their existing condition unless otherwise stated.
These areas are typically rougher in appearance and texture, which is normal.
The Contractor’s warranty does not extend to vertical surfaces unless specifically included.
6. Texture & Slip Resistance
All hard surfaces may be slippery when wet.
Decorative flake systems are designed to have texture; the exact texture level cannot be precisely controlled.
Samples represent color only and do not reflect final texture.
Optional slip-resistant grit may be added if requested before installation.
The Contractor is not responsible for slip, trip, or fall incidents.
7. Crack Repair
Concrete cracks are common and may exist prior to installation or develop over time.
The Contractor will evaluate visible cracks and repair them using the method deemed most suitable based on crack type, size, and condition.
Crack repairs are intended to improve appearance and performance but do not guarantee cracks will not reappear due to concrete movement, settling, moisture, or temperature changes.
Future cracking or coating issues related to substrate movement are not considered defects.
8. Scheduling & Delays
Installation dates are estimated and not guaranteed.
Scheduling may change due to weather, material availability, equipment issues, or other unforeseen circumstances.
Installation date changes do not qualify for price reductions.
9. Customer Readiness
The work area must be fully accessible and ready on the scheduled installation date.
If the crew arrives and cannot proceed due to:
Inaccessible space
Items not removed
Utilities not available
Customer refusal or unpreparedness
A $350 not-ready fee may apply, and the project may need to be rescheduled.
10. Rescheduling
A minimum of 7 days’ notice is required to reschedule.
Rescheduling with less than 7 days’ notice may result in a $250 rescheduling fee.
Rescheduling may delay the project for several weeks.
11. Changes to Scope
Hidden conditions or unforeseen concrete issues may require additional preparation or materials.
Any additional work will be discussed and approved before proceeding.
12. Payment Terms
A 10% non-refundable deposit is due upon signing and reserves materials, scheduling, and labor.
The remaining balance is due upon completion of the project.
Accepted payment methods: cash, check, or credit card (processing fees may apply).
Unpaid balances may result in:
Suspension or voiding of warranty coverage
Collection efforts as permitted by Iowa law
Filing of a mechanic’s lien in accordance with Iowa lien statutes
13. Completion & Inspection
The Customer or a designated representative should be present at completion.
If no inspection occurs at completion, the work will be deemed accepted.
Minor touch-ups do not alter the project’s completion status.
14. Return to Service
Typical cure times (may vary based on conditions):
Light foot traffic: 24 hours
Heavy items: 48 hours
Vehicles: 5 days
Use prior to these timeframes may result in damage not covered by warranty.
15. Warranty Coverage & Limitations
The Contractor warrants that the installed coating system will be free from adhesion failure caused by defective materials or improper installation under normal residential use.
This warranty applies so long as any damage or failure is not caused by conditions outside of the Contractor’s control.
Warranty coverage does not apply to damage or failure resulting from:
Cracking due to substrate movement, settling, or freeze/thaw cycles common in Iowa climates
Moisture vapor transmission, hydrostatic pressure, or moisture-related failures unless a moisture vapor barrier system is installed by the Contractor
Efflorescence, mineral deposits, or discoloration
Abuse, misuse, impact damage, dragging heavy objects, or chemical exposure
Flooding, standing water, plumbing leaks, or groundwater intrusion
Modifications, repairs, or alterations performed by others
Moisture Vapor Barrier (MVB) Warranty If a moisture vapor barrier system is installed by the Contractor, the Contractor warrants the performance of the moisture mitigation system and related coating adhesion against moisture-related failure, provided moisture levels remain within the rated limits of the selected product and the system is installed in accordance with manufacturer specifications. This warranty does not cover failures caused by structural slab movement, cracking, flooding, plumbing leaks, standing water, groundwater intrusion, or hydrostatic pressure exceeding manufacturer limits.
This warranty is limited to repair or replacement of the affected area, at the Contractor’s discretion, and does not include incidental or consequential damages. Full warranty details are provided separately.
16. Dispute Resolution (Iowa)
If a dispute arises, both parties agree to first attempt resolution through good-faith communication.
If unresolved, disputes may be resolved through binding arbitration or mediation as permitted under the laws of the State of Iowa.
Nothing in this Agreement waives or limits either party’s rights under Iowa mechanic’s lien laws or other applicable Iowa statutes.
17. Entire Agreement
This document, along with the signed proposal and any written addenda, represents the entire agreement between the Contractor and Customer. No verbal statements or prior agreements are binding unless included in writing.
18. Moisture & Environmental Conditions (Iowa)
Concrete slabs in Iowa are subject to seasonal moisture changes, freeze/thaw cycles, and groundwater conditions.
The Contractor may perform moisture testing prior to installation.
If moisture levels exceed manufacturer or industry recommendations, the Customer will be notified.
The Customer may elect to add a moisture vapor barrier system prior to installation for an additional charge.
Declining a recommended moisture mitigation system releases the Contractor from responsibility for moisture-related coating failures.
While surface preparation and coatings reduce moisture-related issues, no coating system can fully prevent moisture vapor transmission.
Moisture-related coating failures are not considered defects and are excluded from warranty coverage.
By agreeing to an official quote with a 10% nonrefundable downpayment, customers agree to the following terms and conditions.
